Terms of Service (Required)

  • Chapter 1 General Provisions

    1. Article 1 (Purpose)

      1. 1 These Terms and Conditions set forth the rights, obligations, and responsibilities of the Korea Institute for Advancement of Technology (the “KIAT”) and users in connection with the use of the services provided by KIAT.
      2. 2 These Terms and Conditions apply to the basic terms of use of the GT Online website (http://www.gtonline.or.kr).
    2. Article 2 (Effectiveness and Amendment of the Terms)

      1. 1 These Terms and Conditions shall become effective upon being posted and publicly announced through the GT Online online service and/or by other means.
      2. 2 Where material reasons arise due to KIAT’s circumstances, KIAT may amend these Terms and Conditions without prior notice. Any amended Terms and Conditions shall become effective upon being posted and publicly announced in the same manner as set forth in Paragraph 1.
      3. 3 A member may request withdrawal of membership if the member does not agree to the amended Terms and Conditions. Notwithstanding the foregoing, where the member continues to use the services after the effective date of the amended Terms and Conditions, the member shall be deemed to have agreed to such amendments.
    3. Article 3 (Matters Not Provided for in These Terms)

      1. Matters not expressly provided for in these Terms and Conditions shall be governed by the Framework Act on Telecommunications, the Telecommunications Business Act, the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., and other applicable laws and regulations.
    4. Article 4 (Definitions)

      1. The key terms used in these Terms and Conditions are defined as follows.
        1. 1. General Member
          A person who has entered into a service use agreement with KIAT and has been assigned a user ID.
        2. 2. Non-member
          A person who uses the services without registering as a member.
        3. 3. Administrator
          A person designated by KIAT for the overall management of the services and for their smooth operation.
        4. 4. Points
          Points awarded in accordance with the points operation policy established by GT Online for the purpose of enabling effective use of the services and increasing participation; such points represent an index of amember’s activity level.
        5. 5. Solution Room
          A workspace established by a member who wishes to participate in an ongoing solution contest, in which an individual or group derives solutions in a wiki-style manner.
  • Chapter 2 Execution of the Service Use Agreement

    1. Article 5 (Types of Membership)

      1. The GT Online online service provides for General Members. “General Members” shall mean all members who have registered on the www.gtonline.or.kr website. General Members may use all free services available on the www.gtonline.or.kr website.
    2. Article 6 (Formation of the Service Use Agreement)

      1. 1 In the case of General Members, where a user clicks the “Agree” button, the user shall be deemed to have agreed to these Terms and Conditions. The same shall apply in the event of any amendment to these Terms and Conditions. Where a user does not agree to the amended Terms and Conditions, registration as a member may be cancelled.
      2. 2 The service use agreement shall be formed when KIAT accepts the application for use after the applicant for service use has agreed to these Terms and Conditions.
    3. Article 7 (Application for Use)

      1. A person who wishes to register as a member and use the services shall complete and submit an application by entering the required information in the prescribed membership application form as requested by KIAT.
    4. Article 8 (Acceptance of Application for Use)

      1. 1 Unless special circumstances exist, KIAT shall accept applications for use submitted pursuant to Article 7 in the order in which they are received.
      2. 2 Where any of the following circumstances applies, KIAT may restrict acceptance of an application for use and may defer acceptance until the relevant cause has been resolved.
        1. 1. where sufficient service-related facilities are not available;
        2. 2. where technical difficulties exist; or
        3. 3. where KIAT otherwise deems such restriction or deferral necessary due to its circumstances.
      3. 3 Where KIAT becomes aware of any of the following, KIAT may refuse to accept the application for the service use agreement:
        1. 1. where the application is not made under the applicant’s real name;
        2. 2. where the application is made using another person’s name;
        3. 3. where required information is falsely stated in the application;
        4. 4. where the application is made for the purpose of undermining social stability and order or public morals; or
        5. 5. where the application fails to satisfy other application requirements prescribed by KIAT.
      4. 4 Where acceptance is deferred or refused pursuant to Paragraph 2 or 3, KIAT shall notify the applicant thereof; provided, however, that this shall not apply where notification cannot be made to the applicant for reasons not attributable to KIAT.
    5. Article 9 (Protection of Personal Information)

      1. 1 KIAT shall protect and respect members’ personal information.
      2. 2 KIAT shall use its best efforts to ensure that personal information provided by members to KIAT online in connection with the use of the services is protected. To this end, KIAT has established and complies with a personal information protection policy based on applicable laws and regulations that service providers are required to observe, including the Protection of Communications Secrets Act, the Telecommunications Business Act, and the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. For further details, reference shall be made to KIAT’s personal information protection policy.
      3. 3 KIAT shall collect information relating to members through information provided by members at the time of application for use, information provided for community activities and participation in various events, and other information collected in the course of using the services. Members’ personal information shall be used for the purposes of performing this service use agreement and providing the services hereunder.
      4. 4 KIAT shall not, without the member’s consent, disclose or distribute to any third party, or use for commercial purposes, a member’s personal information obtained in connection with the provision of the services; provided, however, that the foregoing shall not apply in any of the following cases:
        1. 1. where necessary for the settlement of fees in connection with the provision of information and communications services;
        2. 2. where necessary for the preparation of statistics, academic research, or market research, and the information is provided in a processed form that does not permit identification of any specific individual;
        3. 3. where a request is made by a competent authority in accordance with procedures and methods prescribed by applicable laws and regulations for investigative purposes;
        4. 4. where otherwise required under a special provision of other laws; or우
        5. 5. where requested by the Information and Communications Ethics Committee.
      5. 5 KIAT may transmit s to a member’s computer through the services. A member may refuse receipt of s or modify browser settings to provide warnings regarding the receipt of s.
    6. Article 10 (Changes to Contractual Matters)

      1. 1 A member may, at any time, review and amend the member’s personal information through the personal information management function.
      2. 2 Where any information entered at the time of application for use has changed, the member shall update such information online. Any issues arising from a failure to update member information shall be the sole responsibility of the member.
  • Chapter 3 Rights and Obligations of KIAT and Members

    1. Article 11 (Obligations of KIAT)

      1. 1 KIAT shall have an obligation to provide the services continuously and stably, except where any of the following circumstances occurs:
        1. 1. where unavoidable due to repair, periodic inspection, or construction work of service facilities;
        2. 2. where a facilities-based telecommunications service provider as prescribed under the Telecommunications Business Act suspends telecommunications services;
        3. 3. where war, civil disturbance, natural disaster, or a national emergency equivalent thereto has occurred or is likely to occur; or
        4. 4. where use of the services is impeded due to facility failure, excessive use by users, or similar circumstances.
      2. 2 KIAT shall process opinions raised by members in accordance with prescribed procedures. Where such processing requires a certain period of time, KIAT shall notify the member of the reason therefor and the anticipated processing schedule.
      3. 3 KIAT shall maintain strict security over members’ information and shall use such information solely for the operation or improvement of the KIAT site through the provision of quality services, and shall not provide such information to any other institution or individual for any other purpose; provided, however, that the foregoing shall not apply in any of the following cases:
        1. 1. where a request is made by a competent authority for investigative purposes in accordance with applicable laws and regulations;
        2. 2. where requested by the Information and Communications Ethics Committee; or
        3. 3. where otherwise requested pursuant to procedures prescribed under applicable laws and regulations.
    2. Article 12 (Obligations of Members)

      1. 1 Members shall comply with applicable laws and regulations, the provisions of these Terms and Conditions, the user guide, precautions posted on the services, and matters notified by KIAT, and shall not engage in any act that interferes with KIAT’s business operations or the operation of the services.
      2. 2 Without KIAT’s prior consent, members shall not use the services for any profit-making activity, and shall not distribute or post any materials that violate applicable laws.
      3. 3 Members shall be responsible for the maintenance and management of their ID and password, and shall bear full responsibility for all consequences arising from the use of their ID and password. Where a member’s ID and password are used without the member’s authorization, the member shall immediately notify KIAT thereof.
      4. 4 In connection with the services, members shall not engage in any of the following acts:
        1. 1. using or providing to any third party any information obtained through the services by copying, reproducing, modifying, translating, publishing, broadcasting, or otherwise using such information without KIAT’s prior approval;
        2. 2. posting obscene materials on the member’s website or bulletin board, linking to or distributing obscene websites, or otherwise engaging in conduct that undermines social order;
        3. 3. defaming or insulting others, or infringing upon the intellectual property rights or other rights of others;
        4. 4. hacking, distributing computer viruses, or continuously transmitting certain content (including advertising information) against another person’s intent;
        5. 5. unlawfully using another member’s ID;
        6. 6. collecting or storing another user’s personal information;
        7. 7. impersonating any other person, including KIAT employees or administrators;
        8. 8. forging the sender of any content transmitted through the services;
        9. 9. stalking or harassing another person; or
        10. 10. any act that disrupts, or is likely to disrupt, the operation of the services, or otherwise violates applicable laws and regulations.
    3. Article 13 (Disclaimer)

      1. 1 KIAT makes no warranty whatsoever with respect to the accuracy, reliability, or completeness of any information, materials, or facts posted or transmitted by members through the services, and shall not be liable for any damages arising from a member’s selection, use, or reliance on such service-related materials.
      2. 2 KIAT shall not be liable for any damages arising from any profits or benefits expected by a member through use of the services, or from any materials obtained through the services.
      3. 3 KIAT shall have no obligation to intervene in any disputes arising between members or between a member and any third party in connection with the services, nor shall KIAT be liable for any damages resulting therefrom.
      4. 4 Where any disruption or impairment of service use occurs due to a cause attributable to a member, KIAT shall be exempt from any liability.
      5. 5 Where KIAT incurs any damages as a result of a member’s violation of these Terms and Conditions, such member shall indemnify and hold KIAT harmless from and against all damages incurred by KIAT, and shall compensate KIAT in full for such damages.
    4. Article 14 (Damages)

      • Notwithstanding any damages incurred by a member in connection with the services provided by KIAT, KIAT shall not bear any liability therefor, except in cases of KIAT’s gross negligence.
    5. Article 15 (Prohibition of Assignment)

      • Members shall not assign, transfer, or donate their rights to use the services or any status or position under the service use agreement to any third party, nor shall such rights or status be provided as security.
  • Chapter 4 Use of the Services

    1. Article 16 (Scope of Service Use)

      • A member may use the services provided on the GT Online site with a single issued ID; provided, however, that certain content provided separately by affiliated partners may not be available for use.
    2. Article 17 (Provision of Information)

      • KIAT may provide members with various information deemed necessary during use of the services, through notices, e-mail, or other methods.
    3. Article 18 (Fees for Use of Content)

      1. 1 The services provided by KIAT shall, in principle, be free of charge. Notwithstanding the foregoing, paid services and paid information shall be available only upon payment of the fees specified for such services or information.
    4. Article 19 (Members’ Posts)

      • Where KIAT determines that any content posted or registered by a member within the services falls under any of the following, KIAT may delete such content without prior notice:
        1. 1. content that defames or maliciously disparages another member or any third party, thereby harming such person’s reputation;
        2. 2. content that violates public order or good morals;
        3. 3. content that is deemed to be connected to criminal conduct;
        4. 4. content that infringes KIAT’s copyright, a third party’s copyright, or other rights;
        5. 5. content that exceeds the posting period or capacity limits prescribed by KIAT;
        6. 6. content where obscene materials are posted on KIAT’s website or bulletin board, or where obscene sites are linked; or
        7. 7. content that is inconsistent with the nature or purpose of the relevant bulletin board.
    5. Article 20 (Copyright in Posts)

      • Rights in materials posted on the services shall be as follows:
        1. 1. The rights and responsibilities relating to a post shall belong to the poster, and KIAT shall not use such post for commercial purposes other than posting it within the services without the poster’s consent. The foregoing shall not apply where the use is for non-commercial purposes, and KIAT shall have the right to post such content within the services.
        2. 2. Members shall not use materials posted on the services for commercial purposes, including by processing or selling information obtained through use of the services.
    6. Article 21 (Posting of Advertisements and Transactions with Advertisers)

      • 1 A portion of the service investment base that enables KIAT to provide the services to members is derived from revenue generated by the posting of advertisements. Any person who intends to use the services shall be deemed to have consented to the posting of advertisements displayed in connection with the use of the services.
      • 2 KIAT shall not be liable for any loss or damage arising from a member’s participation in, correspondence with, or transactions resulting from advertisers’ promotional activities posted on the services or conducted through the services.
    7. Article 22 (Service Hours)

      • 1 KIAT shall commence provision of the services immediately upon acceptance of a member’s application for use. Provided, however, that where the services cannot be commenced due to KIAT’s operational or technical issues, notice thereof shall be posted on the services or the member shall be notified without delay.
      • 2 The services shall, in principle, be available twenty-four (24) hours a day, seven (7) days a week. Notwithstanding the foregoing, all or part of the services may be temporarily suspended for operational or technical reasons, or all or part of the services may be suspended during a period determined by KIAT for operational purposes. In such cases, KIAT shall provide notice thereof in advance or after the fact.
      • 3 KIAT may separately determine the hours during which each service is available, in which case the relevant details shall be announced in advance.
    8. Article 23 (Suspension of Service Provision)

      • With respect to free services, KIAT may, at any time, modify or discontinue all or any part of the services as deemed necessary by KIAT. In such case, KIAT shall promptly notify members thereof via e-mail and/or the website.
  • Chapter 5 Termination of Agreement and Restriction of Service Use

    1. Article 24 (Withdrawal of Membership and Restriction of Use)

      1. 1 Where a member wishes to terminate the service use agreement, the member shall personally request withdrawal of membership by using the member information management function on the KIAT site.
      2. 2 Where KIAT determines that a member has engaged in any of the following acts, KIAT may terminate the service use agreement without prior notice or may suspend the member’s use of the services for a specified period:
        1. 1. acts contrary to public order or good morals;
        2. 2. acts related to criminal conduct;
        3. 3. planning or carrying out use of the services for the purpose of undermining national interests or the public interest;
        4. 4. theft or unauthorized use of another person’s ID and password;
        5. 5. where the registered name is not the member’s real name;
        6. 6. acts that damage another person’s reputation or cause disadvantage to another person;
        7. 7. double registration by the same user under different IDs;
        8. 8. acts that harm the services or otherwise undermine sound use of the services; or
        9. 9. other acts in violation of applicable laws and regulations or the conditions of use prescribed by KIAT.
  • Chapter 6 Miscellaneous

    1. Article 25 (Rights and Responsibilities Relating to Submissions)

      1. 1 Intellectual property rights in a submission shall vest in the submitter. Notwithstanding the foregoing, where a selected submission has not been applied for or registered as intellectual property, such rights shall vest in KIAT. Where a selected submission is subject to intellectual property rights such as patent rights, utility model rights, or copyrights, consultations may be conducted separately, apart from the awarding of any prize, with respect to the transfer of such intellectual property rights or the grant of a license thereto.
      2. 2 Any unauthorized appropriation or use by a member of submissions posted on the GT Online site shall constitute an infringement of another person’s rights, and civil and criminal liability therefor shall rest solely with the member. In such case, KIAT shall bear no legal responsibility whatsoever.
      3. 3 The unauthorized appropriation or use of another person’s ideas for the purpose of making a proposal shall not be permitted, and in such case, KIAT shall bear no legal responsibility whatsoever.
      4. 4 Where multiple submissions are deemed identical, priority in evaluation shall be given to the submission submitted first, as determined by the decision of the evaluation committee.
    2. Article 26 (Points System)

      1. 1 “Points” shall mean points awarded to members in accordance with the points operation policy established by GT Online for the purpose of enabling effective use of the services and increasing participation, and shall constitute an index representing a member’s activity level.
      2. 2 Points shall not be converted into cash.
      3. 3 KIAT shall not be liable where points are deleted or reduced due to a member’s mistake.
      4. 4 Upon withdrawal of membership or loss of membership status, any remaining points held by the member shall expire and shall not be transferred to any third party.
    3. Article 27 (Jurisdiction and Governing Law)

      1. 1 Matters not stipulated in these Terms and Conditions shall be governed by the relevant laws and customary practices of the Republic of Korea, including the Telecommunications Business Act.
      2. 2 With respect to members, matters relating to the services shall also be governed by any separate terms and policies established by KIAT.
